Article 1 (Purpose)

These Terms set out the basic matters between Zaco Labs ("the Company") and users regarding the use of Dayline and related services ("the Service") provided by the Company, including rights, obligations, responsibilities, conditions of use, and procedures.

Article 2 (Definitions)

Article 3 (Effect and Amendment of the Terms)

These Terms take effect when they are posted on a Service screen or on the Company's website (this page), or otherwise announced to Users. The Company may amend these Terms to the extent that it does not violate applicable laws, including the Act on the Regulation of Terms and Conditions. When amending the Terms, the Company will announce the effective date and the reason for the amendment within the Service or on the Company's website (this page) from at least 7 days before the effective date, or from at least 30 days before it for changes that are unfavourable or material to Users. Where the Company's announcement of the amended Terms also states that a User who does not refuse by the effective date will be deemed to have agreed, a User who continues to use the Service without expressly refusing before the effective date is deemed to have agreed to the amended Terms. A User has the right to refuse the amended Terms, and may stop using the Service and terminate the agreement if they do not agree.

Article 4 (Provision and Modification of the Service)

The Company provides the following services.

The Company may change all or part of the Service as required for operational or technical reasons.

Article 5 (Suspension of the Service and Updates)

  1. The Company may temporarily stop providing all or part of the Service in the event of maintenance, replacement or failure of information and communication equipment, loss of communication, or other substantial operational or technical reasons. In such a case the Company will give notice in advance within the Service or on the Company's website (this page), or afterwards where unavoidable reasons make advance notice impossible.
  2. The Company may end the Service where there are substantial operational or technical reasons. In such a case the Company will give notice within the Service or on the Company's website (this page) at least 30 days before the Service ends.
  3. To maintain the quality and security of the Service, the Company may require the app to be updated to the latest version, and use of the app may be restricted until it is updated.

Article 6 (Obligations of the User)

A User must not do any of the following.

Article 7 (Rights and Responsibility for Records)

Rights to what the Company provides, such as the app and its design, name, and icon, belong to the Company or the legitimate rights holder. Records are stored only on the User's device, and the Company does not access them. The rights to and responsibility for Records rest with the User, who is also responsible for managing Records they share. However, the Posts of a day the User chooses to post to Everyone's lines are stored on the Company's servers.

Article 8 (Everyone's Lines and Posts)

  1. Use of Everyone's lines is governed by these Terms together with the Dayline Community Rules. A User may post after choosing a nickname and agreeing to the Community Rules. Everyone's lines may be used only by Users aged 14 or older.
  2. The rights to and responsibility for Posts rest with the User who posted them. Posts and nicknames are visible to every User of the Service.
  3. The User permits the Company, to the extent necessary to provide the Service, to store Posts, show them to other Users, and show them translated into other languages. This permission ends when the User deletes the Post.
  4. A User may delete their own Posts at any time and may edit the caption of a Post. Deleting a Post also deletes its comments and likes.
  5. Where the Company determines that a Post violates these Terms, the Community Rules, or the law, it may hide the Post from other Users or remove the nickname, and, depending on the severity of the violation, may restrict posting and commenting for a period or indefinitely. When the Company takes such a measure, it informs the User within the Service.
  6. A User may report other Users' Posts and nicknames or block those Users. The Company has no obligation to review Posts in advance.
  7. If a User does not use the Service for one year, the nickname and Posts on the Company's servers are deleted. A User who wants their nickname and all their Posts deleted sooner may delete them in the app's Settings or request it by email at the contact address below.

Article 9 (Advertising)

The Service is provided free of charge, and the app shows ads. The Company may change whether ads are shown, and where and in what form. The content of an ad, and any service it leads to, is the responsibility of the advertiser, and the Company is not involved in dealings or disputes between a User and an advertiser. The app may also show a banner introducing another of the Company's services; tapping it opens that service's web page or its app store page.

Article 10 (Third-Party Services)

The Service uses services provided by third parties, such as maps (Apple Maps, Google Maps), advertising (Google AdMob), and app stores. The content, accuracy, and availability of those services are determined by their providers, and the terms and policies of those providers apply.

Article 11 (Disclaimer)

  1. The Company is not liable for failures in using the Service caused by reasons beyond the Company's control, such as force majeure, reasons attributable to the User, or failures or policy changes of third-party services (app stores, carriers, operating system and device makers, map, advertising and server providers, and so on).
  2. The Service is provided on an "as-is" basis. The Company does not warrant that the Service will be uninterrupted or error-free, or that it is fit for a particular purpose.
  3. Paths, distances, durations, and travel modes are estimates from the device's sensors and may differ from what happened. Users must not rely on Records where accuracy matters, such as surveying, navigation, certifying a workout, proof of attendance or business travel, or as legal evidence. The Company is not liable for any direct, indirect, or consequential damage arising from missing or inaccurate Records, unless caused by the Company's intent or gross negligence.
  4. Automatic recording is affected by the User's device settings, permission settings, operating system policies, battery and power-saving state, the app being force-quit, the device being restarted, and surroundings such as indoors, underground, and between tall buildings. As a result, recording may not start or may break off partway. The Company does not warrant that every movement is recorded without omission.
  5. The Service is not a tool for safety or emergencies. Users must not rely on it for purposes that need a location to be known, such as rescue, protection, or monitoring.
  6. Users must not operate the app while driving, or while on the move without paying attention to their surroundings. The Company is not liable for accidents, injuries, or the like that occur while using the Service, unless caused by the Company's intent or gross negligence.
  7. The distances, durations, travel modes, and the like shown in Records are not health, medical, or fitness advice, and Users must not use them as a basis for such decisions.
  8. Automatic recording uses location while the User moves, which uses battery, and maps, ads, and the like use mobile data. The resulting battery use and data charges are borne by the User.
  9. Records are stored on the User's device and the Company does not keep them, so the Company cannot recover Records lost through deleting the app, changing devices, resetting the device, errors, or the like. The Company is not liable for such data loss unless caused by the Company's intent or gross negligence. Posts made to Everyone's lines are kept on the Company's servers, but Records lost from the device cannot be restored from them.
  10. If a User loses the device or someone else uses it, Records may be seen. Keeping the device locked and secure is up to the User, and the Company is not liable for resulting damage unless caused by the Company's intent or negligence.
  11. Once Records a User shares have been delivered to where the User sent them, the Company cannot manage them, and the Company is not liable for damage arising from their later use, leakage, or redistribution, unless caused by the Company's intent or gross negligence.
  12. Maps, and the place names, roads, satellite imagery, and the like shown on them, are provided by the map provider. The Company does not warrant that they are accurate or up to date.
  13. Posts in Everyone's lines are written by the Users who post them, and the Company does not warrant their accuracy or lawfulness. Unless caused by the Company's willful misconduct or gross negligence, the Company is not liable for damage arising from other Users' Posts.
  14. Translations of Posts are produced by machine and may differ from the original; the Company does not warrant their accuracy.
  15. Posts made to Everyone's lines can be seen by other Users and may be carried outside the Service, for example by screenshots. Unless caused by the Company's willful misconduct or gross negligence, the Company is not liable for damage arising from the use, leakage, or redistribution of a Post after it has been made public.
  16. The Company has no obligation to intervene in disputes that arise between Users, or between a User and a third party, through the Service, and is not liable to compensate for resulting damage unless caused by the Company's intent or gross negligence.
  17. Because the Service is provided free of charge, unless caused by the Company's intent or gross negligence, the Company's liability in connection with the Service, including its modification or discontinuation, is limited to damage that ordinarily arises, and the Company is not liable for damage arising from special circumstances or for indirect or consequential damage.
  18. Nothing in this Article limits or excludes any liability of the Company that cannot be limited or excluded under applicable laws.

Article 12 (Liability of the User)

Where the Company suffers damage because a User has intentionally or negligently violated these Terms or applicable laws, the User must compensate the Company for that damage. Where the Company receives a claim for damages or other objection from a third party because of a User's violation, the User must hold the Company harmless at the User's own responsibility and expense.

Article 13 (Governing Law and Jurisdiction)

These Terms are governed by and construed in accordance with the laws of the Republic of Korea. In the event of a dispute relating to use of the Service, the competent court is determined under the Civil Procedure Act.

Article 14 (Language of the Terms)

These Terms are written in Korean, and versions in other languages are translations provided for Users' convenience. Where the Korean version and a version in another language differ, the Korean version prevails, except where the mandatory laws of the country in which the User resides provide otherwise.
